No service is guaranteed to achieve a particular bearing capacity or soil performance without a signed contract.
You are responsible for providing safe site access, accurate existing utility records, and any permits required for drilling or grouting operations. Delays caused by undisclosed underground obstructions or hazardous materials may result in additional charges and schedule adjustments.
Our liability for any claim arising from our services is limited to the total fee paid for the specific project giving rise to the claim. We are not liable for consequential damages, including foundation failure due to unanticipated subsurface conditions not identified in our sampling or testing program. This limitation is enforceable to the fullest extent permitted by applicable law.
All reports, logs, borehole data, and grouting records produced by Mitconaustralia.com remain our intellectual property. You receive a non-exclusive license to use them for the specific project for which they were prepared. You may not redistribute or publish our data without prior written consent.
Either party may terminate a project agreement with 14 days written notice. Upon termination, you must pay for all services performed and materials used up to the effective date. We reserve the right to suspend services if payment is overdue by more than 30 days.
